A Will is something everyone should consider. A lot of people believe that if you are married and do not have a Will that the whole of your estate will be inherited by your spouse, but that is not always the case. Wills often incorporate Trusts which are an essential part of estate planning to ensure your assets are protected. When a person dies and leaves assets to a beneficiary that individual becomes absolutely entitled and they can do what they wish with their inheritance. As highlighted above, there is no such thing a ‘Standard Will’ as everyone’s circumstances are different. Therefore, it is essential that you receive specialist advice when making your Will. As well as dealing with your affairs on death through your Will it is just as important to ensure your affairs can be dealt with during your life to prevent your loved ones potentially having to apply to the court which can be costly and lengthy. 

The good news is that we are living longer, but the downside is that as we age problems can occur regarding our physical or mental capacity. 

You can take steps to ensure you have planned for such an eventuality by creating a Lasting Power of Attorney (LPA). You can appoint up to four individuals, usually family or friends, or sometimes even a solicitor, to act as Attorneys. Your Attorneys can then essentially ‘step into your shoes’ should the need arise. These documents allow your Attorneys to deal with your property and financial affairs, decisions relating to your health and welfare, or both should you be unable to do so yourself. When it comes to preparing the LPA and how the LPA is used, you can still have your say by including in the documents what you want your Attorneys to do and any restrictions you may want to place on them.
